State Claims: Federal Structure Does Not Override New York Gambling Law

Polymarket re-entered the U.S. after acquiring regulated exchange infrastructure and operating under the federal commodities framework. New York argues federal positioning does not exempt the platform from state gambling laws. The Attorney General’s office states its investigation found Polymarket offered wagering on sporting events without a New York gambling license and exposed users under the state’s legal gambling age of 21 to those markets. The lawsuit asks the court to block operations described as unlicensed gambling and seeks financial penalties, forfeiture of alleged illegal proceeds, and restitution.

Jurisdiction Conflict for Prediction Markets

The case underscores a persistent jurisdiction issue for prediction markets: federal oversight by the Commodity Futures Trading Commission can treat event contracts as commodities, while state regulators may classify the same products as wagers. The tension is sharp for sports-related contracts. Markets on inflation or elections can be framed as forecasting or hedging instruments, while contracts that pay out on sports results resemble conventional sports betting under state law.

The lawsuit does not establish that Polymarket broke the law. Allegations will be tested in court.
